In the event of non-compliance, InMyTrip reserves the right to promptly limit or terminate your access or usage rights to the platform. This includes the removal of non-compliant information, as governed by the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021. By engaging with the InMyTrip platform and utilizing our services, you acknowledge and agree to adhere to the terms outlined in the Terms of Use. If you disagree with these terms, refrain from using the platform and its services.
EMBELLISHED DREAM TOURS PRIVATE LIMITED, an Indian company incorporated under the Companies Act, 2013, with its registered office at 73/2, Kamalnagar, Mirjanhat, Bhagalpur, Bihar (referred to as "INMYTRIP"), acts as the licensee and operator of the Platform. The Platform encompasses online resources such as classified advertisements on the website www.inmytrip.com and its corresponding mobile application, along with an online service facilitating the tourism services by connecting sellers with select partners on the website www.inmytrips.com (collectively known as the "Service"). Both the Service and the Platform, including their websites and mobile applications, are provided subject to the terms outlined in these INMYTRIP Terms of Use (referred to as "Terms").
For the purpose of these Terms, "you" and "your" refer to any individual who uses or accesses the Platform or the Service, whether through manual or automated means. This includes individuals browsing the Platform, sharing tourism information for price estimates, posting comments or content, or responding to advertisements on the Platform. By utilizing the Service, you agree to abide by these Terms. Additionally, when using specific parts of the Service, you agree to adhere to any posted guidelines applicable to that Service. These guidelines may change or be updated at INMYTRIP's sole discretion. It is your responsibility to review these Terms periodically. If you object to any term, condition, guideline, or subsequent changes, or if you are dissatisfied with INMYTRIP or the Service in any way, your only recourse is to immediately cease using INMYTRIP.
INMYTRIP reserves the right to update these Terms at any time at its sole discretion. Notices of changes to the Platform or the Terms may be sent to you by INMYTRIP in accordance with Section xxi (I) herein. While INMYTRIP may provide translations of the English version of the Terms into other languages for your convenience, you acknowledge that the English version governs your relationship with INMYTRIP. In the event of any inconsistencies between the English version and a translation, the English version of the Terms shall prevail.
i. INMYTRIP operates an advanced online platform, serving as a venue for users who comply with these Terms to offer, sell, and buy products and services listed on the Platform. While you may conduct transactions through third-party vendors on the Platform, INMYTRIP is not directly involved in these transactions. You acknowledge that INMYTRIP is not a party to such transactions, has no control over them, and assumes no liability in connection with them. Your use of the Service and the Platform is at your own risk.
ii. INMYTRIP collaborates with select entities to provide additional services related to travel and tourism. These partners may offer services to facilitate a seamless transaction. Once you opt for these services, you acknowledge that you move beyond the Platform's scope, and INMYTRIP has no control over the terms of these services. You are responsible for evaluating the terms and conditions of these third-party providers, and INMYTRIP is not liable for any services availed or payments made to them. You can opt out of these additional services following our Privacy Policy.
iii. You acknowledge that INMYTRIP does not control or take responsibility for various aspects of the Platform, including ads, user communications, and third-party links. Using the Platform exposes you to diverse content, and INMYTRIP is not liable for offensive, inaccurate, or objectionable content. INMYTRIP retains the right to refuse, delete, or move any content violating these Terms. The Platform may contain links to unrelated Third-Party Websites, and your access to them is at your own risk, with INMYTRIP disclaiming any liability.
iv. You are solely responsible for the content you post on the Service, and you affirm that you have the necessary rights and permissions for such content. While you retain ownership rights, by submitting content, you grant INMYTRIP a license to use, reproduce, and display it for Platform purposes. INMYTRIP may automatically generate ad descriptions based on uploaded images, with no warranty on their accuracy. Users have a non-exclusive license to access and contact you regarding posted content. This license terminates when content is removed. INMYTRIP may make your content available to third parties for transaction purposes.
v. INMYTRIP does not endorse or assume liability for user-generated content. Copyright infringement is not allowed, and INMYTRIP may remove infringing content upon proper notification. INMYTRIP can terminate a user's access for repeated infringements or violations of these Terms. The platform reserves the right to determine the appropriateness of content at its sole discretion.
You agree not to post, email, message, host, display, upload, modify, publish, transmit, store, update, or share any information on the Platform, or otherwise make available Content:
i. that violates any law or regulation;
ii. that is copyrighted or patented, protected by trade secret or trademark, or otherwise subject to third-party proprietary rights, including privacy and publicity rights unless you are the owner of such rights or have permission or a license from their rightful owner to post the material and to grant INMYTRIP all of the license rights granted herein;
iii. that infringes any of the foregoing intellectual property rights of any party or is Content that you do not have a right to make available under any law, regulation, contractual or fiduciary relationship(s);
iv. that is harmful, abusive, unlawful, threatening, harassing, blasphemous, defamatory, obscene, pornographic, paedophilic, libelous, invasive of another's privacy or other rights, including bodily privacy, insulting or harassing on the basis of gender, hateful, or racially, ethnically objectionable, disparaging, relating or encouraging money laundering or gambling, or harms or could harm minors in any way, promoting enmity between different groups on the grounds of religion or caste with the intent to incite violence or otherwise unlawful in any manner whatsoever or otherwise inconsistent with or contrary to the laws in force;
v. that harasses, degrades, intimidates, or is hateful towards any individual or group of individuals on the basis of religion, gender, sexual orientation, race, ethnicity, age, or disability;
vi. that violates any (local) equal employment laws, including but not limited to those prohibiting the stating, in any advertisement for employment, a preference or requirement based on race, color, religion, sex, national origin, age, or disability of the applicant.
vii. that threatens the unity, integrity, defense, security, or sovereignty of India, friendly relations with foreign states, or public order or causes incitement to the commission of any cognizable offense or prevents investigation of any offense or is insulting any other nation;
viii. that includes personal or identifying information about another person without that person's explicit consent;
ix. that impersonates any person or entity, including, but not limited to, an INMYTRIP employee, or falsely states or otherwise misrepresents an affiliation with a person or entity;
x. deceives or misleads the addressee about the origin of such messages or communicates any information which is grossly offensive or menacing in nature;
xi. that is false, deceptive, misleading, deceitful, misinformative, or constitutes a "bait and switch" offer;
xii. that constitutes or contains "pyramid schemes," "affiliate marketing," "link referral code," "junk mail," "spam," "chain letters," or unsolicited advertisements of a commercial nature;
xiii. that constitutes or contains any form of advertising or solicitation if (1) posted in areas or categories of the Platform which are not designated for such purposes; or (2) e-mailed to INMYTRIP users who have requested not to be contacted about other services, products, or commercial interests;
xiv. that includes links to commercial services or Third Party Websites, except as specifically allowed by INMYTRIP;
xv. that advertises any illegal services or the sale of any items the sale of which is prohibited or restricted by applicable law, including without limitation items the sale of which is prohibited or regulated by applicable law;
xvi. that contains software viruses or any other computer code, files, or programs designed to interrupt, destroy, or limit the functionality of any computer software or hardware or telecommunications equipment or any other computer resource;
xvii. that disrupts the normal flow of dialogue with an excessive number of messages (flooding attack) to the Service or that otherwise negatively affects other users' ability to use the Service; or
xviii. that employs misleading email addresses, forged headers, or otherwise manipulated identifiers to disguise the origin of Content transmitted through the Service.
xix. that belongs to another person and to which you do not have any right;
xx. that is harmful to the child;
xxi. that deceives or misleads the addressee about the origin of the message or knowingly and intentionally communicates any information which is patently false or misleading in nature but may reasonably be perceived as a fact;
Additionally, you agree not to:
xxii. contact anyone who has asked not to be contacted or makes unsolicited contact with anyone for any commercial purpose, specifically, contact any user to post an advertisement on a third-party website or post any advertisement on behalf of such user; or to "stalk" or otherwise harass anyone;
xxiii. make any libelous or defamatory comments or postings to or against anyone;
xxiv. collect personal data about other users or entities for commercial or unlawful purposes;
xxv. use automated means, including spiders, robots, crawlers, data mining tools, or the like to download or scrape data from the Service, except for internet search engines (e.g., Google) and non-commercial public archives (e.g., archive.org) that comply with our robots.txt file;
xxvi. attempt to gain unauthorized access to computer systems owned or controlled by INMYTRIP or engage in any activity that disrupts, diminishes the quality of, interferes with the performance of, or impairs the functionality of the Service or the Platform.
xxvii. use any form of automated device or computer program (sometimes referred to as "flagging tools") that enables the use of INMYTRIP's "flagging system" or other community control systems without each flag being manually entered by a human that initiates the flag (an "automated flagging device"), or use any such flagging tool to remove posts of competitors, other third parties or to remove posts without a reasonable good faith belief that the post being flagged violates these Terms or any applicable law or regulation.
xxviii. use any automated device or software that enables the submission of automatic postings on INMYTRIP without human intervention or authorship (an "automated posting device"), including without limitation, the use of any such automated posting device in connection with bulk postings or for automatic submission of postings at certain times or intervals; or
xxix. Any Content uploaded by you shall be subject to relevant laws and may be disabled, or may be subject to investigation under appropriate laws. Furthermore, if you are found to be in non-compliance with the laws and regulations, these terms, or the privacy policy of the Site, we may terminate your account/block your access to the Site and we reserve the right to remove any non-compliant Content uploaded by you.
We may impose charges for utilizing certain areas of the Service ("Paid Services"). By utilizing Paid Services on the Website, you enter into an agreement with INMYTRIP, governed by the terms outlined herein. Provisions of the Terms related to the Content are also applicable to Paid Services. Moreover, you remain bound by the Terms concerning your use of the Platform and Services. The terms of Paid Services and the association between you and INMYTRIP are governed by the laws of India. Any claims against INMYTRIP are subject to resolution through mutual discussions or negotiations between you and INMYTRIP. If a dispute remains unresolved within 15 days of discussions, arbitration by a mutually appointed sole arbitrator will follow, in accordance with the Arbitration and Conciliation Act, 1996. We retain the right to modify the price at which these features are made available to you:
• Featured Ads
Featured Ads highlight your advertisement in a designated area of the Website, distinguishing it from other content. The display is sequential, and the duration is either as specified at purchase or 30 days from the original posting date, whichever is earlier. There is no limit to the volume of Featured Ads you may post. You can buy a single ad or bulk packages at discounted prices. INMYTRIP reserves the right to limit the extent and manner in which Featured Ads may be edited by you.
• Boost to Top
Boost to Top elevates your advertisement to the top of the listing space in the city-specific category. The ad remains in that spot until new advertisements are posted. This feature aims to draw attention to live ads, increasing the likelihood of responses. Boost to Top can be availed for an already posted ad but does not extend the ad's validity beyond 30 days from the posting date.
• Auto Boost
Auto Boost automatically elevates your advertisement to the top of the listing space at defined intervals. INMYTRIP has sole discretion in determining the frequency of intervals, varying across categories and locations. This feature continuously draws attention to live ads. Auto Boost can be availed for an already posted ad but does not extend the ad's validity beyond 30 days from the posting date.
• Paid Ads
Paid Ads allow you to post ads after exhausting free limits in a category. The validity may be limited or unlimited, depending on the package purchased. Prices are inclusive of applicable taxes. You can purchase single ads or bulk packages at discounted prices.
Payment for Paid Services
Payment is processed through third-party payment gateways. You may provide your GSTIN, and prices are inclusive of applicable taxes. Refunds are not applicable for unutilized time, but equivalent units are credited for technical glitches preventing feature utilization. The refund policy does not apply if your advertisement violates the Terms, faces abuse reports, or is deleted due to subsequent editing by you.
You have the ability to provide us your Goods and Services Tax Identification Number (GSTIN) on the platform. Your GSTIN details are mandatory for passing on the credit of GST charged. In case you fail to provide us with your GSTIN details, we will assume that you are not registered with the GST authorities, without independently verifying your registration status.
Unless otherwise mentioned on the Website, prices indicated are inclusive of applicable taxes.
Refunds/Cancellation
If you choose to delete or deactivate any Paid Services prior to the period for which it is active, we will not be liable to refund you for any unutilized time. In the event you are not able to avail of the Paid Services on the Website on account of any technical reasons, on receipt of payment confirmation, equivalent units of the paid feature against the ad units you were not able to post shall be credited to your account. For example, if you buy a package of 3 Featured Ad units out of which you have consumed only 2 units and were unable to post the remaining 1 ad unit as a Featured Ad on account of a technical glitch during the lifetime of the package validity, you will be credited only 1 unit of Featured Ad to your account.
The above refund policy shall not be applicable in the event any content in your advertisement is found to be violating the Terms or there has been any abuse reported in relation to your advertisement or your advertisement is deleted or not re-posted on the Website on account of any technical reasons due to any subsequent editing done by you.
In these terms, the term "Posting Agent" refers to a third-party agent, service, or intermediary that proposes to post Content to the Service on behalf of others. The use of Posting Agents, whether directly or indirectly, is strictly prohibited by INMYTRIP without explicit written permission. Furthermore, Posting Agents are not allowed to post Content on behalf of others, either directly or indirectly, or access the Service to post Content for others unless granted express written permission or a license by INMYTRIP.
INMYTRIP provides you with a limited, revocable, non-exclusive license to access and use the Service for personal purposes. This license explicitly excludes the following: (a) access or use of the Service by Posting Agents; or (b) any form of collection, aggregation, copying, duplication, display, or derivative use of the Service, as well as the use of data mining, robots, spiders, or similar tools for extraction, unless expressly permitted by INMYTRIP or as otherwise outlined in these Terms.
However, there is an exception for general-purpose internet search engines and non-commercial public archives that collect information solely for displaying hyperlinks to the Service. To qualify for this exception, these entities must operate from a stable IP address or range of IP addresses using an easily identifiable agent and comply with our robots.txt file. Such activities should be in line with (b) above.
For clarity, a "general-purpose internet search engine" does not encompass websites or search engines specializing in classified listings or any subset of classifieds listings. The license outlined in this section allows you to display individual postings on your website or create hyperlinks, strictly for non-commercial and/or news reporting purposes (e.g., personal blogs or other personal online media). However, exceeding posting limits set by INMYTRIP without express permission will be considered a violation of these Terms.
You may also create a hyperlink to the Platform's home page as long as it does not present INMYTRIP, its employees, affiliates, or agents in a false, confusing, misleading, derogatory, or offensive manner. Any use of the Service beyond the authorized access defined in these Terms immediately terminates the granted permission or license. If you intend to collect, aggregate, copy, duplicate, display, or make derivative use of the Service or any Content for purposes not expressly stated herein (including commercial purposes), you must obtain a license from INMYTRIP.
However, there is an exception for general-purpose internet search engines and non-commercial public archives that collect information solely for displaying hyperlinks to the Service. If you intend to collect, aggregate, copy, duplicate, display, or make derivative use of the Service or any Content for purposes not expressly stated herein (including commercial purposes), you must obtain a license from INMYTRIP.
INMYTRIP assumes no responsibility for any infringement of intellectual property rights arising from materials posted on or transmitted through the site, or items advertised on the site, by end-users, or any other third parties.
If you are the owner of intellectual property rights or an authorized agent acting on behalf of the owner and believe that any Content or other content infringes upon your intellectual property right or the right of the owner you represent, you may submit a notification to INMYTRIP. This should be accompanied by a request for INMYTRIP to, in good faith, remove the relevant Content. You can use the claims of infringement form available here.

You acknowledge and agree that the materials on the Platform, excluding User Content licensed under Section II(iii) of the Terms, such as text, software, scripts, graphics, photos, sounds, music, videos, interactive features ("Materials"), and the trademarks, service marks, and logos ("Marks") contained therein, are licensed to INMYTRIP and are subject to copyright and other intellectual property rights under Indian law. Certain trademarks displayed on the Platform may belong to third parties, and their use is subject to the licenses granted by those third parties to INMYTRIP. You are prohibited from reverse engineering, decompiling, or disassembling such trademarks, and nothing in these Terms grants you any rights related to such trademarks.
Materials on the Platform are provided on an 'AS IS' basis for your information. They may not be used, copied, reproduced, distributed, transmitted, broadcast, displayed, sold, licensed, or otherwise exploited for any other purposes without the prior written consent of the respective owners or licensees. INMYTRIP reserves all rights not expressly granted herein to the Platform and the Materials.
You agree not to engage in the use, copying, or distribution of any Materials other than as expressly permitted herein, including any use, copying, or distribution of Materials of third parties obtained through the Platform for commercial purposes. If you download or print a copy of the Materials for personal use, you must retain all copyright and other proprietary notices.
You agree not to circumvent, disable, or otherwise interfere with security-related features of the Platform or features that prevent or restrict the use or copying of any Materials. The Service is protected to the maximum extent permitted by copyright laws and other applicable laws in India.
The content displayed on or through the Service is protected by copyright as a collective work and/or compilation. Reproduction, modification, creation of derivative works, or redistribution of the Platform, the Materials, or the collective work or compilation is expressly prohibited. Copying or reproducing the Platform, the Materials, or any portion thereof for further reproduction or redistribution is expressly prohibited. You further agree not to reproduce, duplicate, or copy Content or Materials from the Service and to abide by all copyright notices and other notices displayed on the Service. Decompiling, disassembling, or attempting to discover any source code contained in the Service is not allowed. Additionally, you agree not to exploit any aspect of the Service for commercial purposes.
INMYTRIP assumes no responsibility for any infringement of intellectual property rights arising from materials posted on or transmitted through the site, or items advertised on the site, by end-users, or any other third parties.
If you are the owner of intellectual property rights or an authorized agent acting on behalf of the owner and believe that any Content or other content infringes upon your intellectual property right or the right of the owner you represent, you may submit a notification to INMYTRIP. This should be accompanied by a request for INMYTRIP to, in good faith, remove the relevant Content. You can use the claims of infringement form available here.

You acknowledge that while using the Platform, you may encounter Content from various sources, and INMYTRIP is not accountable for the accuracy, usefulness, safety, or intellectual property rights of such Content. You accept and bear all liability for your use of the Platform. Additionally, you understand and recognize that you might come across Content that is inaccurate, offensive, indecent, objectionable, defamatory, or libelous. In doing so, you agree to waive any legal or equitable rights or remedies you may have or acquire against INMYTRIP concerning such Content.
You agree to protect, indemnify, and hold INMYTRIP, its officers, subsidiaries, affiliates, successors, assigns, directors, officers, agents, service providers, suppliers, and employees harmless from any and all claims, damages, obligations, losses, liabilities, costs, or debts, including attorneys' fees, arising from (i) your use of and access to the Platform and/or the Service; (ii) your violation of any term of these Terms; (iii) your infringement of any third-party right, including but not limited to any copyright, trademark, trade secret, or other property, or privacy right; or (iv) any claim that your Content caused damage to a third party. This defense and indemnification obligation will remain in effect even after the termination, modification, or expiration of these Terms and your use of the Service and the Platform.
You acknowledge and consent that the transmission of unsolicited email advertisements or other uninvited communications to INMYTRIP email addresses or through INMYTRIP computer systems is explicitly prohibited by these Terms. You recognize and agree that INMYTRIP may, at times, employ human monitors or automated software to assess email usage, flagging certain words associated with spam or scams in emails exchanged between users within the INMYTRIP email system. The use of communication features on the Service and the Platform between you and any other user must adhere strictly to the Terms. Unauthorized use of INMYTRIP computer systems constitutes a violation of these Terms and may result in civil and criminal penalties for the sender and their agents.
You acknowledge and agree that INMYTRIP is not liable for any interactions you have with organizations and/or individuals on the Platform or through the Service. This includes interactions with representatives of our select partners, as well as the payment and delivery related to travel packages. Any terms, conditions, warranties, or representations associated with such interactions are solely between you and the respective organizations and/or individuals. INMYTRIP is not responsible or liable for any loss or damage incurred as a result of these dealings or interactions. In case of disputes between participants on the Platform or between users and any third party, you understand and agree that INMYTRIP is not obligated to intervene in such disputes. If you have a dispute with one or more other users, you release INMYTRIP, its officers, employees, agents, and successors from any and all claims, demands, and damages (actual and consequential) arising out of or related to such disputes and/or our Service, whether known or unknown, suspected or unsuspected, disclosed or undisclosed.
You acknowledge and agree that INMYTRIP may set limits on the use of the Service, including the maximum number of days Content will be retained, the size of postings, email messages, or other Content, and the frequency and manner of accessing the Service or the Platform. Your account is identified and linked through your mobile number, Facebook account, or email address used for registration. INMYTRIP reserves the right to remove or restrict the usage of duplicate accounts linked through the same mobile number, Facebook account, or email address. INMYTRIP is not responsible for the deletion or failure to store any Content. INMYTRIP may modify, limit, or discontinue the Service (or any part thereof) with or without notice. INMYTRIP has the right, at its sole discretion, to delete or deactivate your account, block your email or IP address, or terminate your access to the Service immediately and without notice, removing any Content, for any reason or no reason, including if it believes you violated these Terms. INMYTRIP is not liable for any termination of your access to the Platform or the Service, and you agree not to attempt to use the Service after such termination.
You expressly acknowledge and agree that the use of the platform and the service is entirely at your own risk, and they are provided on an "as is" or "as available" basis, without any warranties of any kind. All express and implied warranties, including merchantability, fitness for a particular purpose, and non-infringement of proprietary rights, are disclaimed to the fullest extent permitted by law. To the fullest extent permitted by law, INMYTRIP, along with its officers, directors, employees, and agents disclaim all warranties, express or implied, in connection with the platform and your use thereof. INMYTRIP makes no warranties or representations about the accuracy or completeness of the platform's content or the content of any third-party websites linked to the platform and assumes no liability or responsibility for any: (i) Errors, mistakes, or inaccuracies of content, (ii) Personal injury or property damage, of any nature whatsoever, resulting from your access to and use of the platform and service, (iii) Any unauthorized access to or use of our servers and/or any and all personal information and/or financial information stored therein, (iv) Any interruption or cessation of transmission to or from the platform, (v) Any bugs, viruses, trojan horses, or the like transmitted to or through the platform by any third party, and/or (vi) Any errors or omissions in any content or for any loss or damage of any kind incurred as a result of the use of any content posted, emailed, communicated, transmitted, or otherwise made available via the platform or the service. INMYTRIP does not warrant, endorse, guarantee, or assume responsibility for any product or service advertised or offered by a third party through the platform or any hyperlinked website or featured in any banner or other advertising. INMYTRIP will not be a party to or responsible for monitoring any transaction between you, other users, and third-party providers of products or services. As with the purchase of a product or service through any medium or in any environment, you should use your best judgment and exercise caution where appropriate.
In no event shall INMYTRIP, its officers, directors, employees, or agents be liable for direct, indirect, incidental, special, consequential, or exemplary damages (even if INMYTRIP has been advised of the possibility of such damages), resulting from any aspect of your use of the platform or the service. This includes, without limitation, damages arising from the use or misuse of the platform or the service, inability to use the platform or the service, or the interruption, suspension, modification, alteration, or termination of the platform or the service. Such limitation of liability shall also apply with respect to damages incurred by reason of other services or products received through or advertised in connection with the platform or the service or any links on the platform. Additionally, it applies to damages arising from any information, opinions, or advice received through or advertised in connection with the platform or the service or any links on the INMYTRIP site. These limitations shall apply to the fullest extent permitted by law. You specifically acknowledge and agree that INMYTRIP shall not be liable for user submissions or the defamatory, offensive, or illegal conduct of any user or third party, and that the risk of harm or damage from the foregoing rests entirely with you. The platform is controlled and offered by INMYTRIP. INMYTRIP makes no representations or warranties that the platform is appropriate for use in other locations. Those who access or use the platform from other jurisdictions do so at their own volition and risk and are responsible for compliance with local law.
You may not transfer or assign these Terms, and any rights and licenses granted hereunder, but INMYTRIP may assign them without restriction. Any attempt by you to transfer or assign shall be null and void.
You confirm that you are at least 18 years old and have the legal capacity to agree to and comply with these Terms. This Platform is designed for adults, and you assert that you are legally qualified to enter into contracts according to applicable laws. If you are using or accessing this Platform on behalf of someone else, you assert that you have the legal authority to represent that individual or entity. Users under the age of 18 (minors) can only access the Platform with the prior approval of their legal guardian. Minors are prohibited from using the Service. As per Indian law, minors lack the capacity to enter into contracts with third parties, and therefore, they cannot engage in transactions through the Platform. If you are a minor under Indian law, please refrain from conducting any transactions on the Platform. Legal guardians of minors acknowledge that they cannot enter into contracts on behalf of minors or bind them in transactions. As the legal guardian, you recognize that you are entering into independent agreements with third parties, even if you are doing so at the request of a minor. NOTICE TO MINORS: If you are a minor, please refrain from providing us with your personal information, such as email addresses, name, and contact details. If you wish to contact us, kindly do so through your parent or legal guardian.
These Terms, along with other policies presented on the Platform, constitute the comprehensive and exclusive understanding and agreement between you and INMYTRIP, governing your use of the Services and the Platform. They supersede all prior understandings, proposals, agreements, negotiations, and discussions, whether written or oral, between you and INMYTRIP. The Terms and the relationship between you and INMYTRIP are governed by the laws of India. Any claims against INMYTRIP shall be resolved through mutual discussions or negotiations. If a dispute remains unresolved within fifteen (15) days, arbitration by a mutually appointed sole arbitrator will follow, as per the Arbitration and Conciliation Act, 1996. The failure of INMYTRIP to enforce any right or provision of the Terms does not constitute a waiver. If a court deems any provision invalid or inapplicable, both parties agree to seek the court's interpretation in line with their original intention. If any provision is deemed invalid, illegal, or unenforceable, the remaining provisions' validity, legality, and enforceability shall remain unaffected. These Terms apply to and bind the successors and assigns of both you and INMYTRIP.
If you become aware of any violations of the Terms, please report them by contacting us through the link at the bottom of the INMYTRIP homepage at www.inmytrip.com. INMYTRIP's failure to act immediately in response to a breach by you or others does not waive the right to act in response to subsequent or similar breaches. Due to the difficulty of quantifying damages, you agree to pay INMYTRIP the following as liquidated damages (and not as a penalty) if actual damages cannot be reasonably calculated: I. If INMYTRIP establishes limits on your Service access frequency or terminates your access, you agree to pay INMYTRIP Rs 10,000/- for each message posted beyond limits or each day accessing INMYTRIP beyond set limits, whichever is higher. II. Posting Agents violating Terms agree to pay INMYTRIP Rs 10,000/- for each posted item. The engaging party agrees to pay an additional Rs 10,000/- for each item posted by the Posting Agent on their behalf in violation. III. Using INMYTRIP systems for unsolicited e-mail ads incurs a charge of Rs 2500/- for each such e-mail. IV. Posting messages in violation of Terms, except as above, incurs a charge of Rs 10,000/- for each message. V. Unauthorized exploitation of Content (excluding your own) results in a charge of Rs 10,00,000/- for each day of such conduct. VI. If none of the above applies, you agree to pay INMYTRIP s actual damages. INMYTRIP retains the right to seek equitable remedies, including specific performance or injunction, without posting a bond.
